Chargeback Policy

Athlinks has established this Chargeback Policy in an effort to protect the payment ecosystem for our athletes, organizers, directors, sponsors, vendors and all the individuals and businesses using Athlinks. The purpose of this policy is to outline the procedures Athlinks will follow for Chargeback and fraud protection activities.

Policy

1. The Customer is responsible for Chargebacks and Chargeback Fees that are processed against an Event.

2. Athlinks reserves the right to withhold and deduct Chargebacks and Chargeback Fees from payments to Customers.

3. Athlinks reserves the right to invoice Customers for Chargebacks and Chargeback Fees processed against an Event after the Event has concluded.

4. The Customer is ultimately liable for any costs generated by Chargebacks.

5. Athlinks has a right to offset any costs generated by Chargebacks from amounts due to Customers.

6. Athlinks reserves the right to dispute or not dispute a Chargeback.

7. If Athlinks disputes a Chargeback, Athlinks will use the resources available from its payment processors to provide the requested documentation to the Issuer through the Acquirer.

8. Athlinks reserves the right to respond or not respond to Requests for Information.

9. If Athlinks responds to a Request for Information, Athlinks will use the resources available from its payment processor to provide the requested documentation to the Issuer through the acquirer.

10. Athlinks reserves the right to block credit cards after fraudulent Chargebacks.

11. Athlinks reserves the right to block shoppers after fraudulent Chargebacks.

12. The Athlinks Refund Policy will govern refunds.

13. The cancellation policy for each Event will govern cancellations.

Definitions

The following definitions are for this Chargeback Policy and provided for informational purposes only. Athlinks reserve the right to change, modify, revise, add, or eliminate definitions from this section at any time.

i. Acquirer. An acquirer is a financial institution that offers access to the credit card payment network for Merchants. In some instances an acquirer can be a payment processor such as Adyen or Stripe.

ii. Cardholder. A Cardholder acquires a credit card from an Issuer to make payments. Cardholders use credit cards to pay for Event registration on Athlinks.

iii. Chargeback. A Chargeback is a return of credit card funds after a Cardholder challenges a purchase by the credit card company.

iv. Chargeback Fee. Fees are assessed any time a Chargeback is initiated by a Cardholder. Chargeback Fees are in addition to the disputed payment amount.

v. Customer. The Customer is the party using the Athlinks registration and event management platform to organize an Event. The party on whose behalf Athlinks is collecting payment is ultimately the Customer.

vi. Event. An Event is a race or other engagement organized using the Athlinks registration platform. Registration, payment, management, communication, scoring, reporting and other organization and production services are available to Events through the Athlinks registration and event management platform.

vii. Issuer. An Issuer is the bank that issues a credit card to a Cardholder.

viii. Merchant. A Merchant is any entity that accepts credit cards. Athlinks is a Merchant.

ix. Request for Information. A Request for Information is a request from a Cardholder via their Issuer for more information about a payment.
